rite then,nothing to do with CCs but who cares
I part own a company called AWESOME ALLOYS and we have a web site of that name which is .com,its a naff site but it gives people a little bit of info,nothing fancy.
Just noticed that a rival company has awesomealloys.co.uk,click on this and you are redirected to there site.
not really fussed as have too much work on anyway,dont think we losing any,just was wondering if this is legal,can it be stopped,blah blah blah
never start a alloy wheel company,its like the ice cream wars
thanks chaps,can any of you think of a way i can wind them up.

If you actually own the trademark "Awesome Alloys" then i think you could contest it, but it would probably go to court. There's more information here: http://www.icann.org/udrp/udrp.htm
The next job is to get some meta keywords into your HTML (I see there aren't any there at the moment) so that search engines will be able to index it properly and make sure that you come up top of a search in an engine such as Google or Yahoo. You may even be able to add words such as "awesomealloys.co.uk" into your tags on your .com site and try & pick up their searches, although I don't know how successful this would be. There are lots of clever things to get at the top of search engines and people have written essays on them!
But to be honest, unless you're seriously losing business, or they're slating your company on the .co.uk site I wouldn't bother about it.

Matt's exactly right, i looked into this when starting my business and you are not allowed to call yourself anything like Mcdonalds, but there is nothing to stop someone buying that domain name and then trying to sell it to you at a higher price (happens loads) but if you own the name and they are a legally registered business they can be sued or forced to change their name, they could still use the website address though as long as the company isn't called that,

Wicked Wheels are contractors for many manufacturers including Porsche, Ferrari, BMW and Mercedes-Benz.
Seems odd these manufactirers happened to be in the same order? could add weight if you could prove who said that first, that they are trying to profit from your name? At the end of the day though you only cover a relatively small part of thier catchment though pete, so i think the best way would just be to 'out - service' them?!?Awesome Alloys lead the way in the refurbising of alloy wheels on sports cars including including Porsche, Ferrari, BMW and Mercedes-Benz.

In Italy, back in the '90s a guy called Marco Armani registered and bought legally the site www.armani.it.
A while ago, the more famous stilyst sued and won the name back off this poor guy who only wanted to do business with his own name! He didn't want to sell the name back for a profit or anything!
The more famous one only won coz he's more powerful than this poor guy!
I don't think it's fair as he has the same last name!

been doing that for over a yr now,i called them today pretending to be a customer looking for awesome alloys,said when i put name in it came up wicked wheels so i called them,she say she never heard of AA so thats a good start,she not really seem to want to tell me that they refurbished alloys as well.
at the end of the day i take approx 150k of work off WW a yr,if thats the best they can do then im happy

you are not allowed to call yourself anything like Mcdonalds
As far as I understand there are no statutory controls( ie acts of parliment) stopping me as an indivudual or in parnership with others trading as Mcdonalds Restaurants. but McDonalds ( the ones who sell burgers ) would be entitled under civil law to sue for damages and prevent me fron using Mcdonalds Restaurants. This would be because of potential damage to their reputation and intelectual property rights.
McDonalds dont own the name McDonalds in the same way Asda might because they didn't create it. So I could trade as McDonalds Tyres so long as I am not to be seen trading of the reputation of the restaurants so I may not get away with McTyres.( no implcation is to be drawn that I might be suggeating there burgers taste like rubber)
As a limited Company or PLC the law would stop me from calling my company the same or similar to another.
There would appear to be no such legislation governing web address and because of communication across international borders there is unlikely to be. Also a company call shall we say Frogspawn Ltd could trade as Bullfrog if some one else wasn't using that name. But this again would be a matter for civil law ie another company Bullfrog Ltd would have to sue Frogspawn Ltd.
I suppose that you could sue wicked wheels for damages but that is expensive and didifficult to prove especially as they appear to be a bigger concern than you. I would guess that you could reverse the tactic and buy up any free similar addresses to www .wicked-wheels.co.uk and redirect to your web site but you have to be aware that they might have a case for damages against you.
Thing are not always what they appear on screen so as a consumer when buing on the webb I look for several things
1. The sophistication of the web site. if a lot of money appears to have been spent on it it suggest the company behind it is big and or very serious about trading on the web
2. An physical address and land line telephone.
3. follows on from 2. are they an established business or an new webtrader so a litle history/ details of people involved is usefull.
If web does not convince me that they a large enough and relaible organisation I won't buy. The exception would be a small local business. But i would prefer to see a home page which as as an advert efectively giving me all the information I need such as telephone number, where and how you operate, price guide etc. If you have more detailed in formation such as price list and samples of work it can be put on other pages if you don't don't bother. Either headlines or full story anything in between is of no use.

Sorry, Duncan is right i should have explained that a bit clearer, i only used it as an example but it was a bad one, but in your case Pete it is valid as i assume they are providing a very similar or the same service you are, if you have the rights to the name you can in fact sue them or get them to stop trading under that name as they are breaking the law by pretending to be you if you see what i mean
