Legal advice???

On my work today and on route there were some emergency roadworks (dont know the name of company that was working there) and on the way home they were gone. When I drove past a bit of road they were working on my CC went bang and wobbled. had a look at the wheels and there is a huge 10 inch nail in there!!! What should I do???

get the tyre mended / replaced and forget about it. If you could prove where the nail came from which I doubt, you would also have to prove negligence. litigation is costly so some corporate bodies may be persauded just to pay up but you require good negotiating skills. Even if you where to litigate successfully I doubt you would get your costs covered in full. You would probably end up paying more that the cost of the tyre to recover the money from someone else

A lot of people make this mistake with personal injury claims - it is not enough simply to HAVE an accident at work, you have got to actually PROVE that your employer was to blame for the accident. Whilst i dont think proving negligence would be a problem, and they may even believe that the nail came from that stretch of road, but that nail could, in fairness, have fallen off the back of a van or anything.
Try phoning the contractor - you may be able to blag a 'goodwill' payment. I certainly wouldnt spend too much time or effort on it tho (and that is coming from me who can be a right victor meldrew at times)
