Hi guys, i need your help. I have ordered an import with a company (which for the time being shall remain nameless) which came in the wrong spec. I was offered a full refund which i have yet to recieve. It is an internet based company, so i have sent countless emails enquiring about this. I have also made in excess of twenty phone calls. Each time i am promised it will be with me in 48 hours or by the end of the week. I am so angry that i want to reck their reputation but i am holding myself back. Is there anything i can do? They owe me £1500.

Yes Benno there is a lot you can do, kick some B*tt but do it through a solicitor so they know you mean business!

Do i just threaten them with a solicitor or actually get one? I dont want to have to pay out a fortune in legal costs. Of course, if its the only way then fine.

Benno,

I have just finished importing my car and I had endless amounts of set backs and ignored emails. Indeed I kicked up such a stink that I was put through to the dealer directly in France which got matters rolling. I know you do not want to name the company but out of curiosity does it begin with B ?

Well Bunno, it depends how you feel. It would appear that the company have broken the contract themselves by not providing you with the product that you ordered - that is as long as they have no got any get out clauses in your written contract and for that you will have to check the small print.

If it were me, I would first of all threaten them along the lines below and therefore be seen in writing to be giving them one last chance.

1). giving them a strict time agenda for the return of your monies, otherwise you will take legal action after that date and charge them for your costs. You can threaten to take out a small claims summons after your deadline (it only costs approx £40 and a county court in your area has leaflets an help on how to apply which is simple). The mere threat should be sufficient.

2). Tell them you expect and are charge them a reasonable rate of interest on your monies still held by them against your wishes, in line with current rates.

3). Ask them what compensation they intend to provide you with for your inconvenience.

4). Send your letter by recorded delivery giving them 2 weeks to reply and for the matter to be resolved - that way they can't claim not to have received it and always keep copies.

Your other alternative is through a solicitor. This can get expensive so small claims action is a better route as it has been specifically designed for cases such as yours to keep legal costs way down. The first half hour with a solicitor normally is free and one letter drafted from them will probably cost some £25 pounds and may well provide them with the incentive and pressure they need to resolve the matter without further costs.
