Last night I was driving through not so sunny Lewisham when I hit a huge pothole in the road. (About 50 cm long, 10 cm deep). It was neither marked or lighted and hence to say hitting it full on the tyre popped and I was lucky to keep control of the car. :(

Anyways, been hit with a bill today of £110.99 for a new Goodyear Eagle F1 tyre and £19.99 to sort my wheel alignment. A colleague of mine says I have a good chance of making a claim against the council over this.

Anyone had any experience of making a claim for a popped tyre against a local authority or just knows about this stuff anyway?

What do I need to do? Any advice appreciated. :D

First step; take photos of your wheel & tyre, along with identifyable photos of the hole in the road - dated if possible.

Then write to the council with copies of your evidence & invoices and state that you intend to make a claim against them.

In the majority of cases, they settle the claim to avoid court action. If not, you may be able to issue a "small claim" in the county court. Most motor insurance policies now have legal cover included do they not? If so, see if you can get that to pay for legal advice. Don't use a "no win no fee" cowboy - you'll get nothing back even if you win.

Funny that... I was driving from Lewisham to HIther Green Station tonight and hit a pot hole in Manor Lane... blew the tyre wall :censored: . Pumped the tyre weld in, which failed and limped home. So Lewisham Council get two claims from CC owners in the same month ... Will they be suspicious.... Good Luck

Admittedly for a different reason I had a claim of about £700 which I tried to claw back off the council and they said it was an "Act of God" hopefully holes in the road aren't "God's footprint's" like coving stones falling of a council maintained buildings are "Acts of God"!

Yeah mine was the big huge one on Manor Lane as well! Just where the junction with Newstead road is! Exactly the same happened to me. The tyre wall split. That hole is a right B@$stard!!! Good luck with the claim mate. I think there may have been quite a few claims with damage on that hole as I have seen loads of people drive through it daily and almost spin out!

will do one fitted for 96 quid. Its the cheapest Ive found in the area but i dont care cos I hope Lewisham council will pay for it. Broke some of the brittle wheel nut covers too taking them off. Will let you know how I get on.... Still have nightmares of the awful bang on the suspension.

What with that AND the pinking noise (thought it was my camshaft) and a first service soon its all happening.. :!:

I phoned Lewisham Council yesterday to tell them I was pursuing a claim against them. Drove past it tonight and its been filled. Funny that!!!

Anyway I got photos and measurements before they did so if u need any copies just let me know mate. I got the claim form today so it will be winging its way back in the first post tommorow.

As for the tyre I figured as Lewisham will be paying for it I'd get it done on the doorstep by kwik fit mobile. Try www.tyresdiect2u.com, 1 x Good Year Eagle F1 205/45/16 GSD2 fitted anywhere of your choosing (got mine done at my workplace) for £101.00 all in. No messin about and they fit it the same day as long as you call before 11.30am.

Pinking noise? I've got a tappetty noise - is that the same thing? It goes when the engine warms up so I figured the monkies used cheap cooking oil when the changed it for my service... :evil:

Pauline - Takes a while for the oil to get round the engine from cold if your lovely cc's been sitting. You may get noise till the oil reaches the right parts.

Theres a thread on here about manifolds. Think my problems similar. The diagnosis seems right.

This happened to me , November last year, I too had to fork out £100 + for a new tyre and the poxy tyre weld didn't work for me either!!!! :evil:

Anyway, I phoned the local council and they sent me out a claims form to fill in, which I returned along with photo's etc.
The pothole was filled in within 2 days of me phoning and advising them it was there, and I had to wait a whole month for them to tell me:

'It is regrettable when anyone using the highway network sustains damage to their property. I would advise you that the KCC's duties as a highway authority are defined in the Highways act 1980. This requires the highway authority to maintain the highway network within its jurisdiction to a "reasonable standard". The fact that the Act only requires maintenance to a reasonable standard means that it recognises that the highway network cannot be kept in perfect condition and that defect will arise from time to time................I can advise you that Norton Road is inspected twice yearly..........for your information the last inspection was carried out on 28th July 2003, and I can confirm that the defect that is the subject of your claim was not considered a hazard to motorists and other road users..........in view of these circumstances and having considered the precedents that have been set by the courts I am satisfied that KCC has discharged its duties imposed by the highways act 1980. As such liabilty for your claim is denied. :evil: :evil: :evil: :evil:

So don't expect any compensation. Sorry!!

Cheque recieved today. Full price of the replacment tyre. :D Who said don't expect compensation then!??!?!?! ;)
