Hello all,

No been here for a while since I sold my 206cc :-(

Anyway - hopfully some of you can advise me of this:

Just been nabbed by a b****** mobile camera - 61 in 50...bugger!!

Got a NIP form through the post - which I have returned....anybody know what's likley to happen to me??

I have some history:

SP30 - October 1995 - FP03
SP50 - July 1998 - FP03
Sp30 - December 2000 - FP03

Will some of you visit me in jail?? :|

Your first 2 driving convictions are spent.

Its highly unlikely therefore, at that speed with those restrictions, you will get any more than a further 3 points and smallish fine - nothing much to worry about :D :D

In fact, your more likely to visit me in jail - if any more of these bleeding fireworks go off!

Due to the fact the word "Prosecution" was in the letter, the alarm bells starting ringing....I thought I would at least end up in court and get a large fine + a ban...

Persoanlly I like Clarkson's view on the subject....

I thought they were valid for 3 years and can come off your licence after 4? Or is it 5? I'm sure the DVLC/A sites can tell you.

From the DVLA site:

1. Endorsement Guide
Disqualifications, convictions and acceptance of fixed penalties payments in respect of driving offences are notified to DVLA by the courts. The details are entered on to the driver's record and the licence. In addition to paying a fine/fixed penalty the drivers licence will be endorsed with a penalty ranging from 3-11 points or a period of disqualification will be imposed, depending on the seriousness of the offence. Any driver who incurs 12 or more penalty points within a 3-year period faces automatic disqualification under the under "totting -up" system. Information on a driver's entitlement and endorsements are sent to courts and police on request.

Endorsements must remain on a licence for 11 years from date of conviction if the offence is :

drinking/drugs and driving (shown on the licence as DR10, DR20, DR30 and DR80).

causing death by careless driving whilst under the influence of drink/drugs (shown on the licence as CD40,CD50 and CD60).

causing death by careless driving, then failing to provide a specimen for analysis (shown on the licence as CD70).

or 4 years from date of conviction if the offence is as listed below :

reckless/dangerous driving (shown on the licence as DD40,DD60 and DD80),

offences resulting in disqualification.

disqualified from holding a full licence until a driving test has been passed.

or 4 years from the date of offence in all other cases.

you definitely won't get anything else for that speed. i got caught with a mobile camera doing 52 in a 40 and got that.

I was allegedly doing 49 in a 30 (if I was then so was the entire stream of traffic) when I got pulled over. In a Chevette!
3 points + FP.
15/11/1999 so they're about to come off! The downside is I'll have to have a photo licence...

Because as I understand it when you send your licence in to be replaced by a clean one, they replace your old licence with a photo licence. They don't produce the old style one any more.

I think that loophole in the law was closed a while ago...and besides - to late - I've already returned the signed form!

You could try asking for the photo of the car, camera calibration cetificate, operaters (officers) notebook etc to show all is in order. They wont give you it, and i'm sure that breaks the disclosure rules on not springing surprises on you in court. In future you will have to scan the orbituaries for someone to be the driver at the time. I'm sure they wont care about the points on thier licence! ;)
