Hope someone can help just over a month ago we were traveling down the motor way when in front of us a big waste lorry dropped a piece of wood/cardboard as we were travelling at 70mp i had to slam on the brakes as i didnt want to hit it BUT it did on the bottom valance the thing is we had the roof down so could have been worse my hubby has been off work ever since with wiplash so i was wondering if anyone has dealt with any claims direct companys if so can u help thank you
I had a claim with accident group which went really well (bought me a cc anyway ) but obviously they are now bust. Thought claims direct went bust YEARS ago after all the scandal in the papers/watchdog etc?
Claims Direct plc went into receivership in July 2002 and liquidation in January 2003 - leaving many investors in the company bearing significant losses.
Haven't you got legal expenses cover on your insurance? let THEM pick up the tab!
Other than that most solicitors (other than the very very small ones) will offer a no win - no fee qoute if you have a good enough case. With the access to justice bill brought in a while back success fees are now claimable as part of costs too, so there is no need to go through someone like claims direct

you have to prove negligence against someone to have a valid claim.
Can you prove the wood carboard fell of the was lorry even though you saw it you would need other witness or evidence to prove it
Can you prove the lorry driver /owner was negligent in allowing material to fall from the lorry. without records (photos) of the conditon of the lorry at the time or witnesses this will be difficult.
Can you prove that it was necessary to break suddenly and that this caused the whiplash
Even if you could prove a case if you where travelling too close to the lorry this would affect damages you claim
For someone to take on a claim on a no win no fee basis you would need to have a resonable chance of sucess. You woud need plenty of evidence
Go through your insurance company, especially if you have legal cover. Showing that the lorry was on the road at the time will be fairly straightforward to prove. The tacho will have recorded the fact that it was moving and at what speed. Knowing, from their logs, where he came from and where he was going to will show where he was at that time. Knowing, from their logs, what he was carrying will show that it's possible he had the offending item (as opposed to a load of plastic pipes, for example).
Getting anyone to bother doing the above is another matter.
