Someone has smacked into the back of my cousins CC .. same spec as mine but year older ... 1500 quids of damage .. and they did not leave details

It just goes to show ... do not park in public car parks on the road as the owners will not take responsibility .. even though youve paid to leave it there? any legal issues here? the police do not want to know as it was on private land too.

Advice?

Unfortunatly most public car parks have a disclaimer on the wall, don't suppose there was any CCTV on?

Just as a tip which I'm sure some people probably do anyway, it's really handy to always carry a camera in the car and a pen and paper. It's amazing how much more photographic evidence can do rather than word of mouth.
I've left a note for someone before after I've seen someone hit their car in a car park, I think more people should do it!
That'll get the buggers, trouble is a frightening number of people on the road are not insured and if you come across one of them quite frankly you're f

im not sure the disclaimer is legal though? they invited you to park there..... they have some responsibility ... its not like it was free to park .. this is what im wondering about .... dont have camera in car ... but pen and paper always at hand ... think an expensive camera left in car is a bad idea ... most expensive item i have are a cd or 2 .... locked in glove box .... might concider camera ....

ive never seen anyone hit anyone, but I know people do drive with out insurance .. and in some cases without license !!!!! which would invalidate there insurance... (learner driver failing to follow the rules).

What can you do ....

I may be wrong but i think some of the money we pay in road tax goes into a fund where if you are hit by an uninsured driver you can please claim for the damages, it may just be worth looking into, if i can find where i hard it from i'll post it

Yes so long as it was accidental and you weren't behaving recklessly.

It's a question of intent.

Unfortunately Plod tend to assume that one car hitting another is an accident so refuse to investigate. If someone deliberately drives into you its still crinimal damage but careless and reckless driving and failing to report an accident are only offences on the highway

Actually Duncan, the Road Traffic Act was amended in 1992 to to apply to anywhere where the public is present and therefore includes private land and car parks, if the public is present, and not just the highway.

There was a big hoo hah at an annual bike rally held on private land - we always used to get through the gates and take our crash helmets off - but not anymore, they have marshalls making sure we ride with our lids on. Very sensible

They stopped people pulling wheelies (deemed to be reckless riding!) etc - there's the case a couple of years ago of 2 stunt riders participating in organised events who had to be classed as "recognised precision bike riding experts" by a governing body to make them exempt from prosecution.

So Andrew, I'd say hassle the plod as the car park has public access and you might get away with arguing it was a "failure to stop". The owner of the car park will deny any responsibility unless it was caused by their negligence, which I doubt. Have you asked if they have CCTV?

when someone hit my car and wasnt insured i claimed the money back from a group called M.I.B (motor insurers bureau)

they are a company that all insurance bods pay into,then if you get hit buy someone not insured then you claim from this lot

they were in MILTON KEYNES,spent 10 mins looking for address or phone no with no luck,ill keep looking,maybe some info on net somewhere
