I was interested to read this in What Car (April) regarding the new March European Directive on faulty cars:

Car buyers to get more protection if they buy a faulty car. Until now buyers suffering faults had to prove the fault existed before they took delivery to get a refund or replacement.

Under this new law called the "Sale of Consumer Goods and Associated Guarantees" the onus of proof falls on the seller within the first 6 months of ownership.

It applies to the sale of new and used cars from garages but not auctions or sales.

It means the vendors are responsible for making sure their goods meet quality standards AND DESCRIPTION GIVEN IN ADVERTS (such as UK spec) - and for correcting problems. New cars are covered for 2 years while used cars are covered for one year.

This seems a useful addition to the 1979 Sales of Goods Act. Where under the Sales of Goods Act you were more likely to suceed in rejecting a car within a coupe of weeks, the new ligislation extends this period to 6 months.
