I'm glad to see you finally got your money back off simon.
He cannot be trusted :evil:
I was a so called mate and he stung me for £270 on my credit card and never sent goods and it has been 7 months since he charged my card and is still pissing about with refunds. It's a very complicated case but at the end of the day the man in a liar and a conman who will get what is coming to him.
And he now owes me over £500 with solictors fess interest etc etc

And even though he owes me he still keeps his flash cc :evil:
If anybody is still owed money by him or goods i contacts for him

i bought a k&n panel filter on ebay last week. only realised once i had won the auction that it was from simon.

paid by credit card and received it a few days later.

i know others have had problems but my transaction was trouble free.

Just a thought, but why not start the chargeback procedure? Call your credit card company and tell them you dispute the charge.

I agree with Alex, you should also find it even easier to dispute the transaction if you haven't signed for the goods bought over the phone i.e. a "card holder not present" transaction where the onuses is on the retailer to prove that you have received the product in good order.

Some other useful background information. When a retailer such as Simon wishes to set up a facility to take credit cards as payment for his goods he has to find a bank to sponsor him and give him the necessary terminal facilities with which to process the transaction. The contract agreement set up between the bank and retailer basically states that in order to process such a payment the retailer has to provide a service i.e. that the customer receives the product in good order. If the retailer has failed to provide this service then he risks his credit card terminal facilities being taken away and a record of this placed on his personal banking file. In reality, the bank may only resort to this action if they receive a number of complaints per financial quarter.

Another useful piece of information:

If a cardholder disputes a charge, they will ALWAYS get the charge refunded. It may take a few months but it will happen - that's the way the procedure works. The dispute is passed along the chain to the retailer. If the retailer sayys the charge is genuine, the cardholder will be notified. If the cardholder then says "Oh yeah, THAT charge..." then the charge stands. Otherwise, the charge is refunded and the retailer (if they are adamant the payment is due) must seek alternative payment.
